Quick answer: Are mushroom spores legal in Virginia? Yes. Virginia lists psilocybin and psilocyn in Schedule I of the Drug Control Act (Va. Code § 54.1-3446), and neither that section nor the drug-crime sections of the Code mention spores, mycelium or mushrooms. Mushroom spores are legal to buy, own and ship in Virginia for microscopy, taxonomy and educational use.
What is not legal: germinating them. Virginia defines “manufacture” to include “propagation,” and growing psilocybin mushrooms is a felony punishable by five to 40 years in prison. In 2026 Virginia passed a law that prepares for an FDA-approved psilocybin medicine, but it does not legalize mushrooms.

What Virginia law says (and doesn’t say)
Virginia’s drug schedules are in the Drug Control Act, Chapter 34 of Title 54.1 of the Code of Virginia. Section 54.1-3446 is Schedule I. Its subdivision 3, the hallucinogens, controls “any material, compound, mixture, or preparation, which contains any quantity of the following hallucinogenic substances,” and the list includes “Psilocybin” and “Psilocyn.”
That is where the mushroom compounds live in Virginia law. Section 54.1-3446 does not mention spores, mycelium or mushrooms. The drug-crime sections in Chapter 7 of Title 18.2, which cover possession, manufacturing and paraphernalia, do not mention them either. Virginia has never written spores into its statutes.
Why spores are legal when the mushrooms are not
A spore contains no psilocybin and no psilocyn. Schedule I reaches material that “contains any quantity” of a listed substance; a spore contains none, so it is not a Schedule I material. The federal government reached the same conclusion: on January 2, 2024, the DEA’s Drug & Chemical Evaluation Section confirmed in writing that mushroom spores that do not contain psilocybin or psilocin are not controlled. The letter also warns that “if at any time the material contains a controlled substance such as psilocybin or psilocin (for example, upon germination), the material would be considered a controlled substance under the CSA.” Our state-by-state guide covers the federal letter in detail.
Virginia’s definitions in section 54.1-3401 draw the same line. “Manufacture” means “the production, preparation, propagation, conversion, or processing” of a controlled substance, and “production” includes “the manufacture, planting, cultivation, growing, or harvesting of a controlled substance.” Germinating a spore is propagation. The line in Virginia is the same as the federal line: the spore is legal, and the germinated material is not.
Penalties for the mushrooms themselves
Because psilocybin is a Schedule I substance, Virginia’s harshest drug tiers apply to the mushrooms.
- Possession (Va. Code § 18.2-250): a Class 5 felony for any Schedule I or II substance. Under section 18.2-10, a Class 5 felony carries one to 10 years in prison, or, at the discretion of the judge or jury, up to 12 months in jail and a fine of up to $2,500, either or both.
- Manufacture, distribution or possession with intent (Va. Code § 18.2-248): for a Schedule I or II substance, a first offense carries five to 40 years in prison and a fine of up to $500,000. Second and third offenses carry mandatory minimum terms. Because “manufacture” includes propagation, growing mushrooms from spores is charged here.
The paraphernalia law: Va. Code § 18.2-265.3
Virginia’s paraphernalia law turns on design and intent, which is what matters to a spore buyer.
- The definition in section 18.2-265.1 covers equipment designed for, or intended for, use in “planting, propagating, cultivating, growing, harvesting” a controlled substance. It includes kits “intended for use or designed for use in planting, propagating, cultivating, growing, or harvesting” any species of plant that is a controlled substance or from which one can be derived.
- The offense in section 18.2-265.3 is selling, or possessing with intent to sell, drug paraphernalia while knowing, or when one reasonably should know, that it is designed or intended for use to illegally plant, propagate, cultivate or grow a controlled substance, among other uses. It is a Class 1 misdemeanor. An adult who sells paraphernalia to a minor at least three years younger commits a Class 6 felony.
- How courts decide: section 18.2-265.2 lists factors, including “constitutionally admissible statements by the accused concerning the use of the object,” instructions provided with it, advertising, and “the existence and scope of legitimate uses for the object in the community.”
A spore syringe sold for study is not paraphernalia. The analysis changes when the seller or buyer talks about cultivation, supplies grow instructions, or sells the syringe as part of a growing setup. This is why we sell spores for microscopy only, do not provide cultivation instructions, and cancel orders from customers who tell us they intend to cultivate.
Richmond, Arlington, Norfolk: any local decriminalization?
No. We found no Virginia city or county that has passed a psilocybin or “entheogenic plants” deprioritization measure. It would not matter for spores if one had, because spores are already legal statewide. The reform efforts described below have all been bills in the General Assembly.
Psilocybin bills in Virginia, 2024 to 2026
Virginia’s psilocybin bills have focused on medical use and research, and none of them has touched spores. Earlier, in 2023, the Senate passed SB 932, which would have moved psilocybin to Schedule III and created a psilocybin advisory board; a House committee tabled it.
- SB 229 (2024) by Senator Ghazala Hashmi would have had the State Health Commissioner study where to place an Advisory Council on Breakthrough Therapies for Veteran Suicide Prevention. It passed the Senate 35–5, and the House Rules Committee continued it to 2025.
- SB 1101 (2025) would have created that advisory council to support research on FDA-designated “breakthrough therapies” such as psilocybin for veterans. It passed the Senate 40–0 in February 2025, and the House Rules Committee passed it by indefinitely, 18–0, on February 17, 2025.
- SB 1135 (2025) would have let the Board of Pharmacy allow prescribing of a crystalline polymorph form of psilocybin once the FDA approved it. It passed both chambers, and Governor Glenn Youngkin vetoed it on March 24, 2025, calling it premature.
- HB 1347 and SB 379 (2026), by Delegate Laura Jane Cohen and Senator Jennifer Boysko, were signed by Governor Abigail Spanberger in April 2026. They became Chapters 305 and 306 of the 2026 Acts of Assembly. Once the FDA approves a psilocybin formulation “designed to be administered by a health care professional in a health care setting,” the Board of Pharmacy must reschedule that formulation to match the federal scheduling.
The 2026 law does not change the status of mushrooms. Until the FDA approves a psilocybin medicine, nothing happens under it, and when something does happen, it applies only to the approved formulation. Psilocybin mushrooms remain Schedule I in Virginia. None of these bills affects spores, which are legal already.
Buying spores in Virginia
- It is legal to buy and own Psilocybe cubensis spores in Virginia for microscopy, taxonomy and educational use.
- Ordering online is legal. Federal mail rules bar controlled substances and paraphernalia, and spores are neither. We ship to Virginia.
- Use spores for study only. Virginia’s definition of manufacture covers propagation, and its paraphernalia law turns on intended use. Studying spores is a legal hobby, and anything that points toward cultivation is where the law starts.

Frequently asked questions
Is it legal to buy mushroom spores in Virginia?
Yes. Mushroom spores are legal in Virginia because Schedule I lists psilocybin and psilocyn, and spores contain neither.
Is it legal to order mushroom spores online in Virginia?
Yes. No Virginia or federal law prohibits mailing spores. The mail rules cover controlled substances and paraphernalia, and spores are neither.
Are Psilocybe cubensis spores legal in Virginia?
Yes. The species does not change the analysis, because no Psilocybe spore contains a Schedule I substance.
Are psilocybin mushrooms legal in Virginia?
No. Possessing them is a Class 5 felony, and growing or selling them carries five to 40 years in prison for a first offense.
Did Virginia legalize psilocybin in 2026?
No. The 2026 law only tells the Board of Pharmacy to reschedule an FDA-approved psilocybin medicine once one exists. Mushrooms remain Schedule I.
Are mushroom grow kits legal in Virginia?
A kit for culinary species is legal. A kit designed or intended for growing a controlled substance is paraphernalia under Va. Code § 18.2-265.1, and it is also paraphernalia under federal law. We do not sell cultivation kits or supplies.
Has any Virginia city decriminalized psilocybin?
We found no Virginia city or county that has passed a deprioritization measure.
Do you ship spore syringes to Virginia?
Yes, we ship to every Virginia address. The only states we exclude are California, Florida, Georgia and Idaho.
