Are Mushroom Spores Legal in Texas? Yes — Here’s the Statute (2026)

Quick answer: Yes. Texas lists psilocybin and psilocin in Penalty Group 2 of the Texas Controlled Substances Act (Health & Safety Code § 481.103), and the word “spore” does not appear anywhere in Chapter 481. Mushroom spores are legal to buy, own and ship in Texas for microscopy, taxonomy and educational use.

What is not legal: germinating them. Texas defines “manufacture” to include propagation, so producing psilocybin-containing mycelium or mushrooms is a felony, and Texas has its own drug-paraphernalia law (§ 481.125) that covers equipment used or intended for cultivation.

What Texas law says (and doesn’t say)

The Texas Controlled Substances Act is Chapter 481 of the Health and Safety Code. Section 481.103, “Penalty Group 2,” lists the state’s hallucinogens, and the list includes “Psilocin” and “Psilocybin,” along with related tryptamines such as 4-AcO-DMT.

That is where the mushroom compounds live in Texas law. Chapter 481 never uses the words “spore” or “mycelium.” Texas, unlike California, Florida, Georgia and Idaho, has never written spores into its statutes.

Several websites list Texas as “unclear” or “gray area.” Texas is not a gray area. It is a state whose legislature scheduled the chemicals and said nothing about the spores, which is the same position as 45 other states and the federal government.

A spore contains no psilocybin and no psilocin. Penalty Group 2 covers “a material, compound, mixture, or preparation that contains any quantity” of a listed substance; a spore contains none, so it is not a Penalty Group 2 substance. The federal government reached the same conclusion: on January 2, 2024, the DEA’s Drug & Chemical Evaluation Section confirmed in writing that mushroom spores that do not contain psilocybin or psilocin are not controlled, and that the material becomes controlled once it contains psilocybin or psilocin, for example after germination. Our state-by-state guide covers the federal letter in detail.

The line in Texas is the same as the federal line: the spore is legal; the germinated material is not.

Penalties for the mushrooms themselves

  • Possession of a Penalty Group 2 substance (§ 481.116): a state jail felony under one gram; a third-degree felony for one to four grams; a second-degree felony for four to 400 grams; and life or 5 to 99 years in prison for 400 grams or more (§ 481.116(e)). Texas weighs the whole mushroom, “including adulterants or dilutants,” not the psilocybin inside it, so the weight tiers are reached quickly.
  • Manufacture or delivery (§ 481.113): a state jail felony under one gram, the same as possession (§ 481.113(b)); one grade higher than possession for one to four grams and for four to 400 grams; and life or 10 to 99 years in prison for 400 grams or more (§ 481.113(e)). Texas defines “manufacture” to include “propagation,” so germinating spores is manufacturing.

The paraphernalia law: § 481.125

Section 481.125 is the Texas provision that matters most to a spore buyer, because it is the one that turns on intent.

  • Subsection (a) makes it an offense to use, or possess with intent to use, drug paraphernalia “to plant, propagate, cultivate, grow, harvest, manufacture… a controlled substance.” That is a Class C misdemeanor (a fine-only offense).
  • Subsection (b) makes it an offense to deliver paraphernalia “knowing that the person who receives… intends that it be used to plant, propagate, cultivate, grow, harvest…” a controlled substance. That is a Class A misdemeanor, punishable by up to one year in jail, and a repeat offense carries at least 90 days in jail.

Notice that both subsections turn on cultivation intent. A syringe of spores on a microscope slide is not paraphernalia; the same syringe next to cultivation equipment, with a stated plan to use it that way, can be. This is why we sell spores for microscopy only, do not provide cultivation instructions, and cancel orders from customers who tell us they intend to cultivate. It protects them under § 481.125(a) and us under § 481.125(b).

Austin, Houston, Dallas: any local decriminalization?

No. Unlike Denver, Oakland or Ann Arbor, no Texas city or county has passed a measure deprioritizing psilocybin enforcement. It would not matter for spores if one had, because spores are already legal statewide; city measures only affect police priorities around the mushrooms, and they never bind state or federal officers.

Texas and psychedelic research

Texas has funded psychedelic research through House Bill 1802 (2021) and Senate Bill 2308 (2025), but neither law changes the status of psilocybin, which remains Penalty Group 2, and neither mentions spores.

Buying spores in Texas

  • It is legal to buy and own Psilocybe cubensis spores in Texas for microscopy, taxonomy and educational use.
  • Ordering online is legal. Federal mail rules bar controlled substances and paraphernalia; spores are neither. We ship to Texas.
  • Use spores for study only. Texas’s paraphernalia statute is intent-based. Spores for microscopy are legal; anything that points toward cultivation is where the law starts.

Frequently asked questions

Is it legal to buy mushroom spores in Texas?

Yes. Chapter 481 schedules psilocybin and psilocin and says nothing about spores, which contain neither.

Is it legal to order mushroom spores online in Texas?

Yes. There is no Texas or federal law against mailing spores; the mail rules cover controlled substances and paraphernalia, and spores are neither.

Are Psilocybe cubensis spores legal in Texas?

Yes. The species does not change the analysis; no Psilocybe spore contains a Penalty Group 2 substance.

Are psilocybin mushrooms legal in Texas?

No. Possession is a felony at any weight (§ 481.116), and germinating spores is manufacturing (§ 481.113).

Are mushroom grow kits legal in Texas?

A kit for culinary species is legal. Equipment used or delivered with the knowledge that it will be used to cultivate a controlled substance is paraphernalia under § 481.125, and it is also paraphernalia under federal law. We do not sell cultivation kits or supplies.

Has Austin or any Texas city decriminalized psilocybin?

No Texas city or county has passed a deprioritization measure.

Does Texas’s psychedelic research funding mean psilocybin is legal there?

No. The 2021 and 2025 laws fund clinical research under FDA and state supervision. Psilocybin remains a Penalty Group 2 substance for everyone else.

Do you ship spore syringes to Texas?

Yes, to every Texas address. The only states we exclude are California, Florida, Georgia and Idaho.
