Quick answer: Yes, mushroom spores are legal in New Jersey. The state lists psilocybin and psilocyn in Schedule I (N.J.S.A. 24:21-5), and neither that section nor the drug chapters of the criminal code mention spores, mycelium or mushrooms. You can legally buy, own and ship spores in New Jersey for microscopy, taxonomy and educational use.
What is not legal is germinating them. New Jersey defines “manufacture” to include “propagation,” and growing psilocybin mushrooms is a crime. New Jersey’s 2026 psilocybin law creates a hospital research pilot; it does not legalize or decriminalize psilocybin, and it does not change anything about spores.

What New Jersey law says (and doesn’t say)
New Jersey’s drug schedules are in the Controlled Dangerous Substances Act, Title 24 of the New Jersey Statutes. Section 24:21-5 is Schedule I, and subsection e., the hallucinogens, lists “(15) Psilocybin” and “(16) Psilocyn.” The subsection controls “any material, compound, mixture or preparation which contains any quantity of” those substances.
That is where the mushroom compounds live in New Jersey law. Section 24:21-5 does not mention spores. The definitions in N.J.S.A. 2C:35-2 do not mention them, and neither do the possession, distribution or paraphernalia sections of Chapters 35 and 36 of the Code of Criminal Justice. New Jersey has never written spores, mycelium or mushrooms into its statutes.
Why spores are legal when the mushrooms are not
A spore contains no psilocybin and no psilocyn. Schedule I reaches material that “contains any quantity” of a listed substance; a spore contains none, so it is not a Schedule I material. The federal government reached the same conclusion. On January 2, 2024, the DEA’s Drug & Chemical Evaluation Section confirmed in writing that mushroom spores that do not contain psilocybin or psilocin are not controlled. The letter added that “if at any time the material contains a controlled substance such as psilocybin or psilocin (for example, upon germination), the material would be considered a controlled substance under the CSA.” Our state-by-state guide covers the federal letter in detail.
New Jersey’s definition of “manufacture” in N.J.S.A. 2C:35-2 begins with “the production, preparation, propagation, compounding, conversion, or processing of a controlled dangerous substance.” Germination is propagation. The line in New Jersey is the same as the federal line: the spore is legal, and the germinated material is not.
Penalties for the mushrooms themselves
New Jersey lowered the penalty for small amounts of psilocybin in 2021 (P.L.2021, c.9, approved February 4, 2021). Everything else about the mushrooms is still a crime.
- Possession of one ounce or less (N.J.S.A. 2C:35-10a.(5)): a disorderly persons offense, punishable by up to 6 months in jail and a fine of up to $1,000.
- Possession of more than one ounce (N.J.S.A. 2C:35-10a.(1)): a crime of the third degree, which carries three to five years in prison.
- Manufacture or distribution (N.J.S.A. 2C:35-5): manufacturing, distributing or possessing psilocybin with intent to distribute is a crime. The statute’s general paragraph for other Schedule I substances, 2C:35-5b.(13), makes it a third-degree crime with a fine of up to $25,000. Because “manufacture” includes propagation, germinating spores falls under this section.
- Operating a production facility (N.J.S.A. 2C:35-4): maintaining or operating any premises used to manufacture “any substance listed in Schedule I or II” is a crime of the first degree.
The paraphernalia law: N.J.S.A. 2C:36-1 to 2C:36-3
The paraphernalia sections matter most to a spore buyer, because they turn on intended use.
- The definition (2C:36-1) covers equipment and materials “used or intended for use in planting, propagating, cultivating, growing, harvesting, manufacturing” a controlled dangerous substance. It lists factors a court should weigh, including “statements by an owner or by anyone in control of the object concerning its use,” instructions and advertising, and “the existence and scope of legitimate uses for the object in the community.” There is no exemption for research or microscopy, so the analysis is about intent and context.
- Use or possession with intent to use (2C:36-2) paraphernalia to plant, propagate, cultivate or grow a controlled dangerous substance is a disorderly persons offense.
- Distributing or selling paraphernalia (2C:36-3), knowing it will be used for those purposes, is a crime of the fourth degree.
A spore syringe bought for study is not paraphernalia. The same syringe next to cultivation equipment, with a stated plan to use it that way, can be. This is why we sell spores for microscopy only, do not provide cultivation instructions, and cancel orders from customers who tell us they intend to cultivate.
Has any New Jersey city decriminalized psilocybin?
We found no New Jersey city or county that has passed a psilocybin deprioritization measure. The only change to psilocybin penalties in New Jersey came from the Legislature in 2021, when possession of one ounce or less became a disorderly persons offense. It would not matter for spores if a city had acted, because spores are already legal statewide. Several cities in Massachusetts have passed such measures.
The Psilocybin Behavioral Health Access and Services Act
New Jersey’s main psilocybin bill has changed a great deal since it was first filed.
- S2934 (2022–2023 session) was the first version of the Psilocybin Behavioral Health Access and Services Act. It did not pass.
- S2283 (2024–2025 session), sponsored by Senate President Nicholas Scutari, was introduced in January 2024 with an Assembly companion, A3852. As introduced, it would have let adults 21 and older possess up to four grams of psilocybin and would have created licensed psilocybin service centers. The Senate Health Committee removed the personal-possession provisions in June 2024, and later amendments narrowed the bill again.
- The final law, P.L.2025, c.296, creates the Psilocybin Behavioral Health Access and Therapy Pilot Program. It appropriates $6 million so that the Department of Health can fund one hospital in each of the state’s northern, central and southern regions to run psilocybin research that complies with FDA and DEA rules. It also creates the Psychedelic Therapy and Research Advisory Board. Governor Phil Murphy signed it in his final days in office. The official chapter law gives the approval date as January 20, 2026, and some news reports give January 21.
The pilot law does not legalize or decriminalize psilocybin, and it does not change any possession or manufacturing penalty. None of these bills mentions spores.
Buying spores in New Jersey
- It is legal to buy and own Psilocybe cubensis spores in New Jersey for microscopy, taxonomy and educational use.
- Ordering online is legal. Federal mail rules bar controlled substances and paraphernalia, and spores are neither. We ship to New Jersey.
- Use spores for study only. New Jersey’s manufacturing statute covers propagation, and its paraphernalia statute turns on intended use. Spores for microscopy are a legal hobby, and anything that points toward cultivation is where the law starts.

Frequently asked questions
Are mushroom spores legal in New Jersey?
Yes. New Jersey’s Schedule I lists psilocybin and psilocyn, and spores contain neither. No New Jersey statute mentions spores.
Is it legal to buy mushroom spores in New Jersey?
Yes. You can buy spores in New Jersey for microscopy, taxonomy and educational use.
Is it legal to order mushroom spores online in New Jersey?
Yes. There is no New Jersey or federal law against mailing spores. The mail rules cover controlled substances and paraphernalia, and spores are neither.
Are Psilocybe cubensis spores legal in New Jersey?
Yes. The species does not change the analysis, because no Psilocybe spore contains a Schedule I substance.
Are psilocybin mushrooms legal in New Jersey?
No. Possessing one ounce or less is a disorderly persons offense, and possessing more is a third-degree crime. Growing them is manufacturing under N.J.S.A. 2C:35-5. The 2026 pilot law only funds hospital research.
Are mushroom grow kits legal in New Jersey?
A kit for culinary species is legal. A kit used or intended for growing a controlled dangerous substance is paraphernalia under N.J.S.A. 2C:36-1, and it is also paraphernalia under federal law. We do not sell cultivation kits.
Do you ship spore syringes to New Jersey?
Yes, we ship to every New Jersey address. The only states we exclude are California, Florida, Georgia and Idaho.
