Are Mushroom Spores Legal in Montana? Yes — Here’s the Statute (2026)

Quick answer: Are mushroom spores legal in Montana? Yes. Montana lists psilocybin and psilocyn as Schedule I hallucinogens in MCA 50-32-222, and neither that statute nor Montana’s dangerous drug and paraphernalia statutes mention spores, mycelium or mushrooms. Mushroom spores are legal to buy, own and ship in Montana for microscopy, taxonomy and educational use.

Growing them is a different matter. Montana makes it a crime to knowingly or purposely produce, manufacture, prepare or cultivate a dangerous drug, with up to 25 years in prison. Montana lawmakers rejected a psilocybin therapy bill in 2023, and no psilocybin therapy bill or ballot measure has advanced since.

What Montana law says (and doesn’t say)

Montana’s drug schedules are in Title 50, chapter 32, part 2 of the Montana Code Annotated. Schedule I is section 50-32-222. Subsection (4), the hallucinogenic substances, lists “(dd) psilocybin” and “(ee) psilocyn, also known as psilocin,” and it controls “any material, compound, mixture, or preparation that contains any quantity” of them.

Montana’s criminal statutes use the term “dangerous drug,” which MCA 50-32-101 defines as “a drug, substance, or immediate precursor in Schedules I through V set forth in Title 50, chapter 32, part 2.” Psilocybin is therefore a dangerous drug. The schedule names two chemicals. It does not mention spores, mycelium or mushrooms, and neither do the possession, distribution, production or paraphernalia sections of Title 45. Montana has never written spores into its law.

A spore contains no psilocybin and no psilocyn. Schedule I reaches material that “contains any quantity” of a listed substance. A spore contains none, so it is not a Schedule I material. The federal government reached the same conclusion. In a letter dated January 2, 2024, the DEA’s Drug & Chemical Evaluation Section confirmed that mushroom spores that do not contain psilocybin or psilocin are not controlled. The letter added that “if at any time the material contains a controlled substance such as psilocybin or psilocin (for example, upon germination), the material would be considered a controlled substance under the CSA.” Our state-by-state guide covers the federal letter in detail.

Montana’s production statute, MCA 45-9-110, applies to anyone who “knowingly or purposely produces, manufactures, prepares, cultivates, compounds, or processes a dangerous drug.” A spore is not a dangerous drug, but a mushroom grown from one is. The line in Montana is the same as the federal line: the spore is legal, and the germinated material is not.

Penalties for the mushrooms themselves

Montana does not set separate penalty tiers for psilocybin. The general dangerous drug penalties apply:

  • Possession (MCA 45-9-102): criminal possession of dangerous drugs is punishable by up to 5 years in the state prison, a fine of up to $5,000, or both. A person convicted of a first violation “is presumed to be entitled to a deferred imposition of sentence of imprisonment.”
  • Distribution (MCA 45-9-101(3)): selling or otherwise distributing psilocybin is punishable by up to 25 years in prison, a fine of up to $50,000, or both.
  • Production or manufacture (MCA 45-9-110): producing, preparing or cultivating a dangerous drug is punishable by up to 25 years in prison and a fine of up to $50,000. Growing mushrooms from spores is charged here.

The paraphernalia law: MCA 45-10-103

Montana’s paraphernalia chapter (MCA 45-10-101 to 45-10-104) is intent-based, and it is the part of Montana law that matters most to a spore buyer.

  • The definition in MCA 45-10-101 covers equipment “used, intended for use, or designed for use in planting, propagating, cultivating” a dangerous drug, including “kits used, intended for use, or designed for use in planting, propagating, cultivating, growing, or harvesting of any species of plant that is a dangerous drug or from which a dangerous drug can be derived.”
  • Using or possessing paraphernalia with intent to use it (MCA 45-10-103) is a misdemeanor with up to 6 months in the county jail, a fine of up to $500, or both. Delivering paraphernalia, or possessing or manufacturing it with intent to deliver (MCA 45-10-104), carries the same penalty.
  • How courts decide: MCA 45-10-102 lists factors, including “statements by an owner or by anyone in control of the object concerning its use,” “instructions, oral or written, provided with the object concerning its use” and “the existence and scope of legitimate uses for the object in the community.” There is no exemption for research or microscopy, so the question is intent and context.

A spore syringe bought for study is not paraphernalia. The same syringe next to cultivation equipment, with a stated plan to use it that way, can be. This is why we sell spores for microscopy only, do not provide cultivation instructions, and cancel orders from customers who tell us they intend to cultivate.

Missoula, Bozeman, Billings: any local decriminalization?

No. No Montana city or county has passed a psilocybin decriminalization or deprioritization measure, and the national trackers of these measures list none in the state. It would not matter for spores if one had, because spores are already legal statewide.

Psilocybin bills and ballot measures in Montana

  • HB 955 (2023). Rep. Jill Cohenour’s bill would have allowed adults with PTSD, anxiety, depression or substance use disorders to receive psilocybin therapy in licensed, supervised settings, with medical cards and licenses issued by the Department of Revenue. The House Human Services Committee voted it down days after its March 2023 hearing, and the bill died.
  • 2025 session. No psilocybin therapy or decriminalization bill was introduced in the 2025 Legislature.
  • 2026 ballot. None of the proposed or qualified statewide ballot issues for November 2026 deals with psilocybin or psychedelics.

As of September 2026, psilocybin and psilocyn remain Schedule I dangerous drugs in Montana, and the penalties above are current. None of this affects spores.

Buying spores in Montana

  • It is legal to buy and own Psilocybe cubensis spores in Montana for microscopy, taxonomy and educational use.
  • Ordering online is legal. Federal mail rules bar controlled substances and paraphernalia, and spores are neither. We ship to Montana.
  • Use spores for study only. Montana’s paraphernalia statute is intent-based, and its production statute names cultivation. Spores for microscopy are a legal hobby, and anything that points toward cultivation is where the law starts.
