Are Mushroom Spores Legal in Mississippi? Yes — Here’s the Statute (2026)

Quick answer: Yes. Mississippi lists psilocybin and psilocyn as Schedule I hallucinogens in Miss. Code Ann. § 41-29-113, and neither that section nor the definitions, penalty or paraphernalia sections of the state’s drug law mention spores, mycelium or mushrooms. That makes mushroom spores legal in Mississippi to buy, own and ship for microscopy, taxonomy and educational use.

What is not legal is germinating them. Mississippi defines “manufacture” to include the “propagation” of a controlled substance, and “production” to include “planting, cultivation, growing or harvesting.” Growing psilocybin mushrooms falls under that definition, and manufacturing a Schedule I substance is punishable by up to 8 years in prison even at the smallest weight tier.

What Mississippi law says (and doesn’t say)

Mississippi’s drug law is the Uniform Controlled Substances Law, Article 3 of Chapter 29 in Title 41 of the Mississippi Code. Section 41-29-113 is Schedule I. Its subsection (d), “Hallucinogenic substances,” covers “any material, compound, mixture or preparation which contains any quantity of” the listed substances, and the list includes “(29) Psilocybin” and “(30) Psilocyn.” The Legislature re-enacted the full Schedule I list in 2025 when it passed Senate Bill 2356, which added 16 other substances, and psilocybin and psilocyn kept the same place.

That is where the mushroom compounds live in Mississippi law. Section 41-29-113 does not mention spores. Section 41-29-105, the definitions, does not mention them, and neither does the penalty section, 41-29-139. Mississippi has never written spores, mycelium or mushrooms into its statutes. The law controls the chemicals, and a spore does not contain them.

A spore contains no psilocybin and no psilocyn. Schedule I reaches material that “contains any quantity” of a listed substance; a spore contains none, so it is not a Schedule I material. The federal government reached the same conclusion: on January 2, 2024, the DEA’s Drug & Chemical Evaluation Section confirmed in writing that mushroom spores that do not contain psilocybin or psilocin are not controlled. The letter also says that “if at any time the material contains a controlled substance such as psilocybin or psilocin (for example, upon germination), the material would be considered a controlled substance under the CSA.” Our state-by-state guide covers the federal letter in detail.

Mississippi’s definitions in section 41-29-105 draw the same line. “Manufacture” means “the production, preparation, propagation, compounding, conversion or processing of a controlled substance,” and “production” includes “planting, cultivation, growing or harvesting.” The line in Mississippi is the same as the federal line: the spore is legal, and the germinated material is not.

Penalties for the mushrooms themselves

Mississippi sets drug penalties by weight or by “dosage units.” Psilocybin is a Schedule I substance, so the Schedule I and II tiers in section 41-29-139 apply.

  • Possession (§ 41-29-139(c)(1)): less than 0.1 gram is a misdemeanor punishable by up to 1 year in jail, a fine of up to $1,000, or both. From 0.1 gram to under 2 grams, the penalty is up to 3 years in prison and a fine of up to $50,000. From 2 grams to under 10 grams, it is up to 8 years and $250,000. From 10 grams to under 30 grams, it is 3 to 20 years and up to $500,000.
  • Sale or manufacture (§ 41-29-139(a) and (b)(1)): under 2 grams is punishable by up to 8 years in prison and a fine of up to $50,000. From 2 grams to under 10 grams, it is 3 to 20 years and up to $250,000. From 10 grams to under 30 grams, it is 5 to 30 years and up to $500,000. Because “manufacture” includes propagation, germinating spores falls under this subsection.
  • Trafficking (§ 41-29-139(f)): selling or manufacturing 30 grams or more (or 40 or more dosage units) of a Schedule I substance is trafficking, a felony with a prison term of 10 to 40 years and a fine of $5,000 to $1,000,000.

The paraphernalia law: Miss. Code § 41-29-139(d)

The paraphernalia law is the part of Mississippi law that matters most to a spore buyer, because it depends on how an item is meant to be used.

  • The definition in section 41-29-105 covers equipment “used, intended for use, or designed for use” in “planting, propagating, cultivating, growing, harvesting, manufacturing” a controlled substance. It expressly includes kits “used, intended for use, or designed for use in planting, propagating, cultivating, growing or harvesting” any species of plant that is a controlled substance.
  • Using or possessing paraphernalia with intent to use it to “plant, propagate, cultivate, grow, harvest, manufacture” a controlled substance is a misdemeanor under subsection (d)(1), punishable by up to 6 months in the county jail, a fine of up to $500, or both. Selling or delivering paraphernalia while knowing, or when one reasonably should know, that it will be used that way is also a misdemeanor under subsection (d)(2), with the same maximum penalty.
  • How courts decide: the definition lists factors, including “statements by an owner or by anyone in control of the object concerning its use,” whether the owner is a legitimate supplier of similar items, and “the existence and scope of legitimate uses for the object in the community.”

A spore syringe bought for study is not paraphernalia. The same syringe kept next to cultivation equipment, together with a stated plan to grow mushrooms, can be. This is why we sell spores for microscopy only, do not provide cultivation instructions, and cancel orders from customers who tell us they intend to cultivate.

Jackson, Oxford, Hattiesburg: any local decriminalization?

No Mississippi city or county has passed a psilocybin decriminalization or deprioritization measure. The measures passed so far are in states such as Colorado, California, Michigan, Massachusetts and Minnesota, and none of them affects Mississippi. It would not change anything for spores if a Mississippi city did pass one, because spores are already legal statewide. For how the neighboring states handle the question, see our guides for Alabama, Tennessee and Arkansas.

Recent bills and ballot measures in Mississippi

Mississippi’s 2026 session produced two psychedelic laws, and neither one legalizes psilocybin mushrooms or changes anything about spores.

  • Senate Bill 2056 (2026) is a “trigger” law. If the FDA approves a pharmaceutical form of crystalline polymorph psilocybin and the DEA reschedules it, Mississippi will automatically schedule that approved drug product on the state schedules as well. The Governor signed it in March 2026. Psilocybin itself stays in Schedule I.
  • House Bill 314 (2026), the Ibogaine Drug Development Clinical Trial Act, lets the State Department of Health select a research consortium to run an ibogaine clinical trial aimed at FDA approval. The Governor signed it on March 26, 2026. Ibogaine is a different drug, and the law does not cover psilocybin.

Mississippi voters cannot put a psilocybin measure on the ballot right now. On May 14, 2021, the Mississippi Supreme Court held that the state’s initiative process no longer works because the Constitution ties it to five congressional districts and Mississippi has had only four since the 2000 census. A 2026 Senate proposal to restore the initiative process died in February 2026. None of this affects spores.

Buying spores in Mississippi

  • It is legal to buy and own Psilocybe cubensis spores in Mississippi for microscopy, taxonomy and educational use.
  • Ordering online is legal. Federal mail rules bar controlled substances and paraphernalia, and spores are neither. We ship spore syringes to Mississippi.
  • Use spores for study only. Mississippi’s paraphernalia law depends on intended use, and its definition of manufacture includes propagation. Studying spores is a legal hobby, and anything that points toward cultivation is where the law starts to apply.
