Are Mushroom Spores Legal in Iowa? Yes — Here’s the Statute (2026)

Quick answer: Are mushroom spores legal in Iowa? Yes, they are. Iowa Code section 124.204 lists psilocybin and psilocyn as Schedule I hallucinogenic substances, and neither that section nor the definitions and penalty sections of chapter 124 mention spores, mycelium or mushrooms. You can buy, own and ship spores in Iowa for microscopy, taxonomy and educational use.

What is not legal is germinating them. Iowa defines “manufacture” to include “propagation,” and “production” to include “planting, cultivation, growing, or harvesting” of a controlled substance. Manufacturing psilocybin is a class C felony. A bill to create a state psilocybin therapy program passed the Iowa House in 2025 but never got a Senate floor vote before the 2026 session ended.

What Iowa law says (and doesn’t say)

Iowa’s Uniform Controlled Substances Act is chapter 124 of the Iowa Code. Schedule I is section 124.204, and subsection 4 covers hallucinogenic substances: “any material, compound, mixture, or preparation, which contains any quantity of the following hallucinogenic substances.” Paragraph “s” of that list is “Psilocybin,” and paragraph “t” is “Psilocyn.”

That is where the mushroom compounds live in Iowa law. Section 124.204 does not mention spores. The definitions in section 124.101 and the penalty provisions in section 124.401 do not mention spores, mycelium or mushrooms either. Iowa has never written spores into its law.

A spore contains no psilocybin and no psilocyn. Iowa’s Schedule I reaches material that “contains any quantity” of a listed substance, and a spore contains none, so it is not a Schedule I material. The federal government reached the same conclusion. On January 2, 2024, the DEA’s Drug & Chemical Evaluation Section confirmed in writing that mushroom spores that do not contain psilocybin or psilocin are not controlled. The letter also says that “if at any time the material contains a controlled substance such as psilocybin or psilocin (for example, upon germination), the material would be considered a controlled substance under the CSA.” Our state-by-state guide covers the federal letter in detail.

Iowa’s definitions make the same point. Section 124.101(19) defines “manufacture” as “the production, preparation, propagation, compounding, conversion, or processing of a controlled substance,” and section 124.101(28) says “production” includes “the manufacture, planting, cultivation, growing, or harvesting of a controlled substance.” Germinating a spore is propagation. The line in Iowa is the same as the federal line: the spore is legal, and the germinated material is not.

Penalties for the mushrooms themselves

Psilocybin is a Schedule I substance in Iowa, so the following penalties apply to psilocybin mushrooms.

  • Possession (Iowa Code 124.401(5)): a first offense is a serious misdemeanor, which carries up to one year in jail and a fine of $430 to $2,560 under section 903.1. A second offense is an aggravated misdemeanor, and a third or later offense is a class D felony.
  • Manufacture, delivery or possession with intent (Iowa Code 124.401(1)(c)(9)): for any Schedule I, II or III substance not covered by a more specific rule, this is a class C felony, plus a fine of $1,000 to $50,000. Because “manufacture” includes propagation and “production” includes cultivation and growing, growing mushrooms from spores is charged here.

The paraphernalia law: Iowa Code 124.414

Iowa’s paraphernalia law is the part of chapter 124 that matters most to a spore buyer, because it depends on how an item is used.

  • The definition covers equipment, products or materials “used or attempted to be used in combination with a controlled substance” to manufacture a controlled substance, to introduce one into the body, to test its strength or purity, or to enhance its effect.
  • The syringe exclusion: the definition does not include hypodermic needles or syringes “if manufactured, delivered, sold, or possessed for a lawful purpose.”
  • The offense and penalty: it is unlawful to “knowingly or intentionally manufacture, deliver, sell, or possess drug paraphernalia.” A violation is a simple misdemeanor, which carries up to 30 days in jail and a fine of $105 to $855.

A spore syringe bought for study is not paraphernalia. The same syringe used to start a mushroom grow can be. This is why we sell spores for microscopy only, do not provide cultivation instructions, and cancel orders from customers who tell us they intend to cultivate.

Des Moines, Iowa City, Cedar Rapids: any local decriminalization?

No Iowa city or county has passed a psilocybin decriminalization or deprioritization measure. A local measure would not change anything for spores in any case, because spores are already legal statewide. If you live near the state line, our guides for Illinois, Minnesota, Missouri and Wisconsin explain the law in those states.

House File 978 and psilocybin therapy in Iowa

Iowa’s main psilocybin bill in the 2025–2026 General Assembly was House File 978. It would have created a state-regulated program for psilocybin therapy, with licensed in-state production and administration in clinical settings. Patients had to be 21 or older, the program was aimed first at post-traumatic stress disorder, and the number of patients was capped at 5,000.

  • April 21, 2025: the Iowa House passed HF 978 by a vote of 84 to 6.
  • March 19, 2026: the Senate Health and Human Services Committee recommended the bill with an amendment.
  • May 1, 2026: the Senate Ways and Means Committee also recommended it with an amendment.
  • May 2026: the session ended without a Senate floor vote, and the bill died with the 91st General Assembly.

As of September 2026, Iowa has no psilocybin therapy program and no decriminalization law, and psilocybin remains a Schedule I substance. None of this affects spores, which were legal before the bill was filed.

Buying spores in Iowa

  • It is legal to buy and own Psilocybe cubensis spores in Iowa for microscopy, taxonomy and educational use.
  • Ordering online is legal. Federal mail rules bar controlled substances and paraphernalia, and spores are neither. We ship to Iowa.
  • Use spores for study only. Iowa’s paraphernalia law turns on use, and its definitions of manufacture and production include propagation and cultivation. Spores for microscopy are a legal hobby, and anything that points toward cultivation is where the law starts.
