Are Mushroom Spores Legal in Hawaii? Yes — Here’s the Statute (2026)

Quick answer: Are mushroom spores legal in Hawaii? Yes. Hawaii lists psilocybin and psilocyn as Schedule I hallucinogens in HRS 329-14, and neither that statute nor Hawaii’s drug offense and paraphernalia statutes mention spores, mycelium or mushrooms. Mushroom spores are legal to buy, own and ship in Hawaii for microscopy, taxonomy and educational use.

Hawaii is strict about the mushrooms themselves. Possessing any amount of psilocybin is a class C felony, and manufacturing any amount is a class A felony. Hawaii has studied psilocybin therapy through a 2023 task force and several bills, but as of September 2026 none of them has changed the law.

What Hawaii law says (and doesn’t say)

Hawaii’s Uniform Controlled Substances Act is Chapter 329 of the Hawaii Revised Statutes. Schedule I is section 329-14. Subsection (d), the hallucinogenic substances, lists “(26) Psilocybin” and “(27) Psilocyn,” and it controls “any material, compound, mixture, or preparation that contains any quantity” of them.

The criminal penalties are in a separate place, the drug offense sections of the Hawaii Penal Code, HRS 712-1240 and following. Those sections call every Schedule I and Schedule II substance, except marijuana, a “dangerous drug.” Psilocybin is therefore a dangerous drug in Hawaii. None of these statutes mentions spores, mycelium or mushrooms. Hawaii has never written spores into its law.

A spore contains no psilocybin and no psilocyn. Schedule I reaches material that “contains any quantity” of a listed substance. A spore contains none, so it is not a Schedule I material. The federal government reached the same conclusion. In a letter dated January 2, 2024, the DEA’s Drug & Chemical Evaluation Section confirmed that mushroom spores that do not contain psilocybin or psilocin are not controlled. The letter added that “if at any time the material contains a controlled substance such as psilocybin or psilocin (for example, upon germination), the material would be considered a controlled substance under the CSA.” Our state-by-state guide covers the federal letter in detail.

Hawaii defines “manufacture” twice. Chapter 329 defines it as “the production, preparation, propagation, compounding, conversion, or processing of a controlled substance.” The Penal Code defines it as “to produce, prepare, compound, convert, or process a dangerous drug,” including “by extraction from substances of natural origin.” Germinating a spore is propagation, and growing a mushroom produces the drug. The line in Hawaii is the same as the federal line: the spore is legal, and the germinated material is not.

Penalties for the mushrooms themselves

Hawaii calls its drug crimes “promoting a dangerous drug” in the first, second and third degrees. Because psilocybin is a dangerous drug, these are the tiers that apply:

  • Possession of any amount (HRS 712-1243): promoting a dangerous drug in the third degree, a class C felony with up to five years in prison. There is no misdemeanor tier for psilocybin.
  • Possession of a quarter ounce or more, or any distribution (HRS 712-1242): the second degree, a class B felony with up to 10 years in prison. Distributing any amount of psilocybin falls here.
  • Possession of one and one-half ounces or more, or distribution of three-eighths of an ounce or more (HRS 712-1241): the first degree, a class A felony.
  • Manufacturing any amount (HRS 712-1241(1)(d)): also promoting a dangerous drug in the first degree, a class A felony. Growing psilocybin mushrooms from spores can be charged here.

The weight thresholds are the aggregate weight of any mixture or substance containing the drug, not the weight of the pure drug. The prison terms for class B and class C felonies come from HRS 706-660.

The paraphernalia law: HRS 329-43.5

Hawaii’s paraphernalia law is intent-based, and it is milder than its drug possession law.

  • The definition in HRS 329-1 covers equipment “used, primarily intended for use, or primarily designed for use, in planting, propagating, cultivating, growing, harvesting, manufacturing” a controlled substance.
  • Using or possessing paraphernalia with intent to use it, and delivering it when the seller knows or reasonably should know it will be used with drugs, are each a violation with a fine of no more than $500.
  • Delivering paraphernalia to a minor at least three years younger is a class B felony, and advertising paraphernalia is a class C felony.
  • How courts decide: the definition lists factors, including “statements by an owner or anyone in control of the object concerning its use” and “instructions, oral or written, provided with the object concerning its use.” There is no exemption for research or microscopy, so the question is intent and context.

A spore syringe bought for study is not paraphernalia. The same syringe next to cultivation equipment, with a stated plan to use it that way, can be. This is why we sell spores for microscopy only, do not provide cultivation instructions, and cancel orders from customers who tell us they intend to cultivate.

Honolulu, Maui, Hawaii County, Kauai: any local decriminalization?

No. No Hawaii county has passed a psilocybin decriminalization or deprioritization measure, and the national trackers of these measures list none in the state. It would not matter for spores if one had, because spores are already legal statewide.

The Breakthrough Therapies Task Force and recent bills

Hawaii has spent several years studying psilocybin therapy. None of this work has changed the criminal law, and none of it affects spores.

  • The Breakthrough Therapies Task Force (2023). The Governor’s Office of Wellness and Resilience set up an 11-member task force to help Hawaii expand therapeutic access to MDMA and psilocybin, which the FDA has designated “breakthrough therapies.” It held its first meeting on August 29, 2023, and was asked to finish its final report by the end of that year.
  • SB 1042 (2025–2026). This bill would have created a two-year Mental Health Emerging Therapies Pilot Program in the Office of Wellness and Resilience to support research into psychedelic-assisted treatment with substances such as psilocybin and MDMA. It passed the Senate and the House in different versions in 2025, and the two chambers could not agree in conference. It carried over to 2026 and did not pass.
  • SB 3199 (2026). This bill would have created a Mental Health Emerging Therapies Task Force at the University of Hawaii’s John A. Burns School of Medicine to prepare the state for breakthrough therapies and clinical research. It passed the Senate in March 2026 and passed the House in a different version in April 2026. It then went to a conference committee, and the bill died when the session ended without a final version.

As of September 2026, psilocybin and psilocyn remain Schedule I substances in Hawaii, and possession of any amount is still a felony.

Buying spores in Hawaii

  • It is legal to buy and own Psilocybe cubensis spores in Hawaii for microscopy, taxonomy and educational use.
  • Ordering online is legal. Federal mail rules bar controlled substances and paraphernalia, and spores are neither. We ship to Hawaii.
  • Use spores for study only. Hawaii treats any amount of psilocybin as a felony and manufacturing any amount as a class A felony. Spores for microscopy are a legal hobby, and anything that points toward cultivation is where the law starts.

Frequently asked questions

Is it legal to buy mushroom spores in Hawaii?

Yes. Hawaii’s Schedule I lists psilocybin and psilocyn and says nothing about spores, which contain neither.

Is it legal to order mushroom spores online in Hawaii?

Yes. There is no Hawaii or federal law against mailing spores. The mail rules cover controlled substances and paraphernalia, and spores are neither.

Are Psilocybe cubensis spores legal in Hawaii?

Yes. The species does not change the analysis, because no Psilocybe spore contains a Schedule I substance.

Are psilocybin mushrooms legal in Hawaii?

No. Possessing any amount is a class C felony in Hawaii, and larger amounts or any distribution are higher felonies. Manufacturing any amount is a class A felony.

Are mushroom grow kits legal in Hawaii?

A kit for culinary species is legal. A kit for growing a controlled substance is paraphernalia under HRS 329-1, and it is also paraphernalia under federal law. We do not sell cultivation kits or supplies.

Did Hawaii legalize psilocybin therapy?

No. A 2023 task force studied it, and bills in 2025 and 2026 would have created a pilot program and a new task force, but none of them passed.

Are mushroom spores legal in Hawaii?

Yes. Spores contain no psilocybin or psilocyn, and no Hawaii statute mentions them. The rule is the same in every county.

Do you ship spore syringes to Hawaii?

Yes, to every Hawaii address. The only states we exclude are California, Florida, Georgia and Idaho.
