Are Mushroom Spores Legal in Delaware? Yes — Here’s the Statute (2026)

Quick answer: Yes, mushroom spores are legal in Delaware. Delaware lists psilocybin and psilocyn as Schedule I hallucinogens in 16 Del. C. § 4714(d), and neither that schedule nor the definitions of the Uniform Controlled Substances Act mention spores, mycelium or mushrooms. Spores contain neither compound, which makes mushroom spores legal in Delaware to buy, own and ship for microscopy, taxonomy and educational use.

What is not legal is germinating them. Delaware defines “manufacture” to include “propagation” of a controlled substance, and manufacturing any amount is at least a class D felony. Possessing psilocybin mushrooms is a class B misdemeanor for small amounts and a felony from 2.5 grams up.

What Delaware law says (and doesn’t say)

Delaware’s drug law is the Uniform Controlled Substances Act, Chapter 47 of Title 16 of the Delaware Code. Section 4714 is Schedule I. Subsection (d), the hallucinogens, controls “any material, compound, mixture or preparation which contains any quantity of the following hallucinogenic substances,” and the list includes “(14) Psilocybin” and “(15) Psilocyn.”

That is where the mushroom compounds live in Delaware law. Section 4714 does not mention spores. Section 4701, the definitions, does not mention spores, mycelium or mushrooms, and neither do the offense sections. Delaware has never written spores into its statutes.

A spore contains no psilocybin and no psilocyn. Schedule I reaches material that “contains any quantity” of a listed substance; a spore contains none, so it is not a Schedule I material. The federal government reached the same conclusion: on January 2, 2024, the DEA’s Drug & Chemical Evaluation Section confirmed in writing that mushroom spores that do not contain psilocybin or psilocin are not controlled. The letter adds that “if at any time the material contains a controlled substance such as psilocybin or psilocin (for example, upon germination), the material would be considered a controlled substance under the CSA.” Our state-by-state guide covers the federal letter in detail.

Delaware’s definition of “manufacture” in section 4701 is “the production, preparation, propagation, compounding, conversion or processing of a controlled substance.” Germinating a spore to grow mushrooms is propagation. The line in Delaware is the same as the federal line: the spore is legal, and the germinated material is not.

Penalties for psilocybin mushrooms in Delaware

Delaware grades drug crimes by “quantity tiers” in section 4751C. Psilocybin is not named in the tier list, so it falls under the catch-all for “any substance as described in § 4714 of this title that is not otherwise set forth.” For that group, Tier 1 is 2.5 grams or more, Tier 2 is 5 grams or more, and Tier 3 is 12.5 grams or more (or 12.5, 25 and 62.5 doses).

  • Possession (16 Del. C. § 4763): a class B misdemeanor, which carries up to 6 months in jail and a fine of up to $1,150.
  • Possession of a tier quantity: a Tier 1 quantity is a class G felony (§ 4756, up to 2 years). A Tier 2 quantity is a class E felony (§ 4753, up to 5 years). A Tier 3 quantity is a class B felony (§ 4752, 2 to 25 years).
  • Manufacture, delivery or possession with intent (§ 4754): a class D felony, up to 8 years, for any amount. With a Tier 2 quantity it is a class C felony (§ 4753, up to 15 years), and with a Tier 3 quantity it is a class B felony (§ 4752). Because “manufacture” includes propagation, growing mushrooms from spores is charged here.

The paraphernalia law: 16 Del. C. § 4771

Delaware’s paraphernalia law is the part of the code that matters most to a spore buyer, because it turns on intended use.

  • The definition in section 4701 covers equipment “used, intended for use or designed for use, in planting, propagating, cultivating, growing, harvesting, manufacturing” a controlled substance. It names “kits used, intended for use or designed for use in planting, propagating, cultivating, growing or harvesting of any species of plant which is a controlled substance.”
  • Using or possessing paraphernalia with intent to use it is a class B misdemeanor (§ 4774(a)). Delivering, selling or manufacturing it for delivery, knowing or when one “should reasonably know” it will be used to plant, propagate or cultivate a controlled substance, is a class G felony (§ 4774(c)). Selling it to a person under 18 is a class E felony.
  • How courts decide: section 4772 lists factors, including “statements by an owner or by anyone in control of the object, concerning its use,” instructions provided with the object, advertising, and “the existence and scope of legitimate uses for the object in the community.” There is no exemption for microscopy, so the question is always intent and context.

A spore syringe bought for study is not paraphernalia. The same syringe next to cultivation equipment, with a stated plan to grow mushrooms, can be. This is why we sell spores for microscopy only, do not provide cultivation instructions, and cancel orders from customers who tell us they intend to cultivate.

Wilmington, Dover, Newark: any local decriminalization?

No. No Delaware city or county has passed a psilocybin decriminalization or deprioritization measure. It would not matter for spores if one had, because spores are already legal statewide.

Psilocybin bills in Delaware

We found no psilocybin bill filed in Delaware’s 153rd General Assembly (2025–2026), and the UC Berkeley Center for the Science of Psychedelics tracker lists no notable psychedelics legislation for Delaware. Psilocybin remains a Schedule I substance in Delaware. None of this affects spores.

Buying spores in Delaware

  • It is legal to buy and own Psilocybe cubensis spores in Delaware for microscopy, taxonomy and educational use.
  • Ordering online is legal. Federal mail rules bar controlled substances and paraphernalia, and spores are neither. We ship spore syringes to Delaware.
  • Use spores for study only. Delaware’s paraphernalia law is intent-based, and its definition of “manufacture” includes propagation. Studying spores is a legal hobby, and anything that points toward cultivation is where the law starts.

Frequently asked questions

Is it legal to buy mushroom spores in Delaware?

Yes. Delaware’s Schedule I lists psilocybin and psilocyn and says nothing about spores, which contain neither.

Is it legal to order mushroom spores online in Delaware?

Yes. There is no Delaware or federal law against mailing spores. The mail rules cover controlled substances and paraphernalia, and spores are neither.

Are Psilocybe cubensis spores legal in Delaware?

Yes. The species does not change the analysis, because no Psilocybe spore contains a Schedule I substance.

Are psilocybin mushrooms legal in Delaware?

No. Possessing them is a class B misdemeanor, and possessing 2.5 grams or more is a felony. Growing them is manufacturing a controlled substance, which is at least a class D felony.

Has Delaware decriminalized psilocybin?

No. Delaware has not decriminalized psilocybin, no Delaware city has passed a deprioritization measure, and we found no psilocybin bill in the 2025–2026 session.

Are mushroom grow kits legal in Delaware?

A kit for culinary species is legal. A kit for growing a controlled substance is paraphernalia under Delaware law and under federal law. We do not sell cultivation kits or supplies.

Do you ship spore syringes to Delaware?
