Quick answer: Are mushroom spores legal in Arkansas? Yes. Arkansas controls psilocybin and psilocyn as Schedule I hallucinogens through the Department of Health’s List of Controlled Substances, and neither that list nor the Arkansas drug statutes mention spores, mycelium or mushrooms. You can legally buy, own and ship Psilocybe cubensis spores in Arkansas for microscopy, taxonomy and educational use.
Germinating them is not legal. Arkansas defines “manufacture” to include “propagation,” and it defines “production” to include “planting, cultivation, growing, or harvesting.” Possessing even a fraction of a gram of psilocybin mushrooms is a felony in Arkansas.

What Arkansas law says (and doesn’t say)
Arkansas does not print its drug schedules in the Arkansas Code. Section 5-64-201 gives the Secretary of the Department of Health the power to add, delete or reschedule controlled substances, and the Department publishes the result as the List of Controlled Substances for the State of Arkansas. Schedule I of that list covers “any material, compound, mixture, or preparation, which contains any quantity of” the hallucinogens it names, and psilocybin and psilocyn are both on it.
That is where the mushroom compounds live in Arkansas law. The Department of Health’s list does not mention spores, mycelium, mushrooms or the genus Psilocybe. The Arkansas Code sections that define the drug offenses (the definitions in section 5-64-101, possession in 5-64-419, manufacture in 5-64-427 and paraphernalia in 5-64-443) do not mention them either. Arkansas law controls the chemicals, not the spores.
Why spores are legal when the mushrooms are not
A spore contains no psilocybin and no psilocyn. Schedule I reaches material that “contains any quantity” of a listed substance, and a spore contains none, so it is not a Schedule I material. The federal government reached the same conclusion. On January 2, 2024, the DEA’s Drug & Chemical Evaluation Section confirmed in writing that mushroom spores that do not contain psilocybin or psilocin are not controlled. The same letter added: “if at any time the material contains a controlled substance such as psilocybin or psilocin (for example, upon germination), the material would be considered a controlled substance under the CSA.” Our state-by-state guide covers the federal letter in detail.
Arkansas draws the line in the same place. Section 5-64-101 defines “manufacture” as “the production, preparation, propagation, compounding, conversion, or processing of a controlled substance,” and it defines “production” as “the manufacture, planting, cultivation, growing, or harvesting of a controlled substance.” The spore is legal, and the germinated material is not.
An Arkansas case: a fraction of a gram is a felony
No Arkansas court has ruled on spores by themselves. A 2025 appeal shows how seriously the state treats the mushrooms.
In Evans v. State, 2025 Ark. App. 283, a Saline County defendant was convicted of possessing 0.2227 grams of mushrooms containing psilocin, which the Court of Appeals described as a Schedule I controlled substance. The charge was a Class D felony under section 5-64-419(b)(2)(A). The Court of Appeals affirmed the conviction in May 2025. A quarter of a gram of mushrooms was enough for a felony conviction, which is the practical difference between a spore and a mushroom in Arkansas.
Penalties for the mushrooms themselves
Arkansas measures drug amounts by “aggregate weight, including an adulterant or diluent,” so the whole weight of the mushrooms counts, not just the psilocybin inside them.
- Possession (Ark. Code 5-64-419): for a Schedule I substance other than methamphetamine, fentanyl, heroin or cocaine, possessing less than 2 grams is a Class D felony. Possessing 2 grams or more but less than 28 grams is a Class C felony, and possessing 28 grams or more but less than 200 grams is a Class B felony.
- Manufacture (Ark. Code 5-64-427): manufacturing a Schedule I or Schedule II substance other than methamphetamine, fentanyl, heroin or cocaine is a separate felony offense. Because “manufacture” includes propagation and “production” includes growing, germinating spores into psilocybin mushrooms is charged under this section.
The paraphernalia law: Ark. Code 5-64-443
The paraphernalia law is the Arkansas provision that matters most to a spore buyer, because it turns on intended use.
- The definition in section 5-64-101 covers equipment, products and materials “used, intended for use, or designed for use in planting, propagating, cultivating, growing, harvesting, manufacturing” a controlled substance, and it includes a kit used or intended for use in producing or preparing a controlled substance.
- Using or possessing paraphernalia to grow a controlled substance is a Class D felony under section 5-64-443(b). The statute covers paraphernalia used to “plant, propagate, cultivate, grow, harvest, manufacture” a controlled substance. Possessing paraphernalia to ingest or inhale a controlled substance is generally a Class A misdemeanor under section 5-64-443(a).
- How courts decide: the definition lists factors, including “a statement by an owner or by anyone in control of the object concerning its use,” instructions provided with the object, “national and local advertising concerning the object’s use,” and “the existence and scope of legitimate uses for the object in the community.” There is no exemption for research or microscopy, so the question is always intent and context.
A spore syringe bought for study is not paraphernalia. The same syringe next to cultivation equipment, with a stated plan to grow mushrooms, can be, and in Arkansas that is a felony rather than a misdemeanor. This is why we sell spores for microscopy only, do not provide cultivation instructions, and cancel orders from customers who tell us they intend to cultivate.
Little Rock, Fayetteville, Fort Smith: any local decriminalization?
No. No Arkansas city or county has passed a psilocybin decriminalization or deprioritization measure, and Arkansas has no statewide decriminalization or therapy program. It would not matter for spores if a city had, because spores are already legal statewide. Nearby, our guides to Missouri, Tennessee and Oklahoma explain where those states stand.
Bills and ballot measures in Arkansas
We found no psilocybin bill in the Arkansas General Assembly’s 2025 regular session, and the policy trackers we checked list no psychedelic legislation for Arkansas through mid-2026. The measures on Arkansas’s November 2026 ballot were all referred by the legislature, and none of them concerns psilocybin or any other drug. None of this affects spores, which are legal under current law.
Buying spores in Arkansas
- It is legal to buy and own Psilocybe cubensis spores in Arkansas for microscopy, taxonomy and educational use.
- Ordering online is legal. Federal mail rules bar controlled substances and paraphernalia, and spores are neither. We ship to Arkansas.
- Use spores for study only. Arkansas treats psilocybin mushrooms harshly, and its paraphernalia law makes grow equipment a felony. Spores for microscopy are a legal hobby, and anything that points toward cultivation is where the law starts.
Frequently asked questions
Are mushroom spores legal in Arkansas?
Yes. Arkansas controls psilocybin and psilocyn, not spores. Neither Arkansas’s drug statutes nor the Department of Health’s list names mushroom spores or mycelium.
Is it legal to buy mushroom spores in Arkansas?
Yes. Arkansas’s Schedule I lists psilocybin and psilocyn and says nothing about spores, which contain neither substance.
Is it legal to order mushroom spores online in Arkansas?
Yes. No Arkansas or federal law forbids mailing spores. The mail rules cover controlled substances and paraphernalia, and spores are neither.
Are Psilocybe cubensis spores legal in Arkansas?
Yes. The species does not change the analysis, because no Psilocybe spore contains a Schedule I substance.
Are psilocybin mushrooms legal in Arkansas?
No. Possessing less than 2 grams of psilocybin mushrooms is a Class D felony, and larger amounts are higher felonies. Growing them is manufacturing a Schedule I controlled substance, which is also a felony.
Are mushroom grow kits legal in Arkansas?
A kit for culinary species is legal. A kit used or intended for use in producing a controlled substance is drug paraphernalia under Arkansas law, and using or possessing paraphernalia to grow a controlled substance is a Class D felony. It is also paraphernalia under federal law. We do not sell cultivation kits or supplies.
Has any Arkansas city decriminalized psilocybin?
No. No Arkansas city or county has passed a decriminalization or deprioritization measure.
Do you ship spore syringes to Arkansas?
Yes, we ship to every Arkansas address. The only states we exclude are California, Florida, Georgia and Idaho.
